Register Marriage

According to Indian law, a man who has completed 21 years of age and a woman who has completed 18 years of age are eligible to marry. Foreigners who have completed the above age can also get married in India. This Marriage Age Act has been in force in our country since 1978. Before 1978, the age of marriage in India was 18 for men and 14 for women. A bill to increase the marriageable age for women from the current 18 to 21 has been introduced in the Indian Parliament and is pending due to opposition from opposition parties and social activists. As it stands, the marriageable age for women continues to be 18. A marriage between a woman or a man who has not reached the age of maturity is not legally valid. Also, under the Child Marriage Prohibition Act, persons responsible for underage marriages will be prosecuted and arrested. Government marriage certificates for Christian marriages can be obtained under both the Tamil Nadu Marriage Registration Act - 2009 and the Indian Christian Marriage Act - 1872. Both the bride and groom should be Christians. A certificate of marriage from a Christian religious institution must be submitted as a document. Basic documents for marriage registration such as age proof and marriage certificate should also be submitted. Couples need not go directly to the registrar's office for registration under the Indian Christian Marriage Act - 1872. For Christian marriages it is sufficient if the relevant documents are handed over by a licensed Christian pastor. The Act was passed in the Tamil Nadu Legislative Assembly on 30th June 2009. However, due to opposition from various quarters (especially Muslims), it was not implemented immediately. It came into force from 24th November 2009.  After the Act came into force, registration of marriages became compulsory in Tamil Nadu.  According to this, the marriage should be registered within 90 days from the registrar's office. If you register within 90 days of marriage, you only need to pay a fee of Rs 100. If you register within 91 to 150 days of marriage, you will have to pay a total of Rs 150 along with a penalty fee of Rs 50. If you register after 150 days of marriage, you will have to pay a maximum fee of Rs 1300 along with a penalty.  Proof of age, proof of residence and place of marriage should be submitted at the time of marriage registration. www.registermarriages.in

இச்சட்டம் 2009 ஆம் ஆண்டு ஜூன் மாதம் 30 ஆம் தேதி தமிழ்நாடு சட்டமன்றத்தில் நிறைவேற்றப்பட்டது. இருப்பினும் , பல்வேறு தரப்பினரிடமிருந்து ( குறிப்பாக இஸ்லாமியர்கள்) எழுந்த எதிர்ப்புக்கள் காரணமாக , உடனடியாக நடைமுறைப்படுத்தப்படவில்லை.  2009 ஆம் ஆண்டு நவம்பர் 24 ஆம் தேதி முதல் நடைமுறைக்கு வந்தது.  இச்சட்டம் நடைமுறைக்கு வந்த பிறகு , திருமணங்களை பதிவு செய்வது தமிழகத்தில் கட்டாயமாக்கப்பட்டது.  இதன் படி , திருமணம் நடந்து 90 நாட்களுக்குள் திருமணத்தை பதிவாளர் அலுவலகம் சென்று பதிவு செய்ய வேண்டும். திருமணம் முடித்து 90 நாட்களுக்குள் பதிவு செய்தால் கட்டணம் ரூபாய் 100 மட்டுமே செலுத்தினால் போதுமானது. திருமணம் முடித்து 91 முதல் 150 நாட்களுக்குள் பதிவு செய்தால் அபராத கட்டணம் ரூபாய் 50 சேர்த்து மொத்தம் ரூபாய் 150 செலுத்த வேண்டும். திருமணம் முடித்து 150 நாட்கள் கடந்த பிறகு பதிவு செய்தால் , அதிகபட்சமாக ரூபாய் 1300 வரை அபராதத்துடன் கூடிய கட்டணமாக செலுத்த நேரிடும்.  திருமணப் பதிவின்போது வயதுச்சான்று , இருப்பிடச் சான்று மற்றும் திருமணம் நடைபெற்ற இடம் ஆகியவற்றுக்கான ஆவணங்கள் சமர்ப்பிக்கப்பட வேண...

This amendment was made under the Hindu Marriage Act. Applicable to Hindus only. Jains, Buddhists, Sikhs and Parsis can use this law. Muslims and Christians are not eligible under this Act. All castes of Hindus can marry under this law. People belonging to different castes among Hindus can marry under this Act, even if they have inter-caste marriages. Photographs taken at the wedding ceremony are not listed by the registration department in the list of documents to be submitted while registering marriages and obtaining certificates. Some sub-registrars insist on submitting photographs taken at the wedding event. But as per the rules laid down by the Registration Department, it is not a proper practice to request such.   Special Marriage Act --------------------------------------- This was the first marriage law of independent India. In 1954, this Act was brought into force by the Government of India. According to this, any man or woman in any state or union territory of India (except the then Jammu and Kashmir) can marry. This law is a cross-caste marriage law. Couples may be of the same caste or religion or of different castes or religions.
